Discoverability of Expert Work Product

The testifying expert has become standard in many types of federal litigation. In such cases, each side uses paid experts to explain complicated issues to the judge or jury. The experts are most effective when they have complete information and are able to help form a party’s case theories from the outset. Thus, keeping an expert “in the loop” is important. This requires frequent communication between attorney and expert, which in many cases demands sharing attorney work product between testifying expert and attorney. As experts have become central to the strategy of a case, opposing counsel may seek to examine expert materials to gain insights to an opposing party's tactics.

Shortly after I am writing this column, the Smithsonian Channel will air a program on Making The Monkees.  The Smithsonian website proclaims: “In 1967, four unknown  actors in a low budget, teen-oriented TV show became the biggest pop music act in the world. … They were The Monkees, and they weren’t a band in any true sense – at least at first.”
