California’s New Rule 8.3: The Four Questions

As of August 1, 2023, California has added rule 8.3 to our Rules of Professional Conduct, which requires lawyers to report the misconduct of other lawyers.  This program will evaluate when, how, why, and to whom a lawyer will need to report.  Although the State Bar has provided guidance on the new rule and we will discuss that guidance, many practitioners are uncertain of how this rule impacts them.  This program will aim to provide practical answers to some of the uncertainty. Speakers: 

Rachelle Cohen, Esq., is a principal at Valensi Rose, PLC in Century City.  Her practice focuses on advising on legal ethics issues and assisting clients with their business transactions.  Rachelle is a member of the California Lawyers Association (CLA) Ethics Committee.  She also is a member and former Chair of the Los Angeles County Bar Association Professional Responsibility and Ethics Committee. Rachelle speaks frequently and has written about legal ethics issues and corporate and transactional issues and has been a lecturer at the USC Gould School of Law.

Neil J. Wertlieb, Esq., is the General Counsel for the law firm Milbank LLP, where he also served as a Partner at the firm for approximately two decades.  

Neil is an Inaugural Co-Chair & Founding Member of the Ethics Committee of the California Lawyers Association, and a former Chair of the Ethics Committees of the California State Bar and the Los Angeles County Bar Association.  He is also an Adjunct Professor teaching transactional law at UCLA and UC Berkeley Law School, a Senior Advisor at Harvard Law School Executive Education, and the General Editor of Ballantine & Sterling: California Corporation Laws, a 7-volume treatise on the laws governing business entities in California.

Neil is an experienced transactional lawyer, educator and ethicist, who has served as an expert witness in over 100 disputes involving business transactions and corporate governance, and in cases involving attorney malpractice and attorney ethics.  Neil received his law degree in 1984 from the UC Berkeley School of Law, and his undergraduate degree in Management Science from the School of Business Administration also at the University of California at Berkeley.
